1. ACCEPTANCE OF TERMS
   1. These Terms of Use (“Terms”) constitute a legally binding agreement between you and National Media Pty Ltd (ABN 94 121 601 394) (“National Media”, “we”, “us”, “our”) governing your access to and use of National Media’s digital properties, including websites, mobile applications and digital publications (collectively, the “Services”).
   2. By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.
   3. These Terms apply to all visitors, users, and others who access or use the Services. Your continued use of the Services following any modifications to these Terms constitutes your acceptance of such changes.

3. CHANGES TO TERMS
   1. We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our Services with a new “Last Updated” date. Your continued use of our Services after such modifications constitutes your acceptance of the revised Terms.

4. INTELLECTUAL PROPERTY RIGHTS
   1. Our Content
      1. All content, features and functionality on our Services, including text, graphics, logos, images, videos and software, are owned by National Media, its licensors, or other content providers and are protected by Australian and international copyright, trademark, and other intellectual property laws.
   2. Limited License
      1. We grant you a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes in accordance with these Terms.

5. USER ACCOUNTS AND CONDUCT
   1. Account Registration
      1. Some areas of our Services require registration. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials.
      2. Prohibited Activities
         1. you agree not to:
            1. Use our Services for any illegal purpose
            2. Impersonate any person or entity
         2. Interfere with the proper functioning of the Services
         3. Engage in unauthorised data collection or mining
         4. Circumvent any access restrictions
         5. Upload viruses or malicious code

6. USER CONTENT
   1. Submission of Content
      1. When you submit content to our Services (including comments, reviews, or forum posts), you grant National Media a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify and distribute such content across our platforms.
   2. Content Standards
      1. User content must not:
         1. Infringe any intellectual property rights
         2. Be defamatory, obscene or offensive
         3. Contain private or personal information without consent
         4. Violate any applicable law
         5. Be false, misleading or deceptive

7. PRIVACY
   1. Your privacy is important to us. Our Privacy Policy, available at https://nationalmedia.com.au/privacy-policy, explains how we collect, use and disclose information about you. By using our Services, you consent to the practices described in our Privacy Policy.

8. THIRD-PARTY LINKS AND CONTENT
   1. Our Services may contain links to third-party websites and content. We are not responsible for any third-party content or websites and do not endorse any third-party products or services.

9. DISCLAIMERS AND LIMITATIONS OF LIABILITY
   1. Disclaimer of Warranties
      1. Our Services are provided “as is” without warranties of any kind, either express or implied, to the fullest extent permitted by law.
   2. Limitation of Liability
      1. To the maximum extent permitted by law, National Media will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of our Services.
      2. Consumer Guarantees
         1. Nothing in these Terms limits your rights under the Australian Consumer Law. For major failures with services, you are entitled to cancel the service contract and obtain a refund for unused portions, or compensation for reduced value.

10. INDEMNIFICATION
    1. You agree to indemnify and hold harmless National Media and its officers, directors, employees and agents from any claims, liabilities, damages, losses, costs or expenses arising from your violation of these Terms.

11. TERMINATION
    1. We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

12. GOVERNING LAW
    1. These Terms are governed by Queensland law. Any disputes relating to these Terms will be subject to the exclusive jurisdiction of the courts in Queensland. 

13. SEVERABILITY
    1. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14. ENTIRE AGREEMENT
    1. These Terms, together with our Privacy Policy, constitute the entire agreement between you and National Media regarding our Services.
