1. SCOPE & INTERPRETATION

  1. 1.1.Definitions
    1. 1.1.1. “Privacy information” includes personal information and sensitive information.
    2. 1.1.2. “Personal information” includes information that is capable of identifying an individual such as name, address and date of birth.
    3. 1.1.3. “Sensitive information” includes information relating to health or religion, racial or ethnic origin.
    4. 1.1.4. “We”, “us” and “our” refer to National Media Pty Ltd.
    5. 1.1.5. “APPs” refer to the Australian Privacy Principles in the Privacy Act 1988 (Cth).
  2. 1.2.Purpose of this policy
    1. 1.2.1. This Privacy Policy explains how National Media Pty Ltd protects your personal information. Along with our Collection Statement and notification procedures, our Privacy Policy lays down the principles by which we collect, store, use and disclose any personal information you provide to us or we collect from other sources.
    2. 1.2.2. Our Privacy Policy also informs customers and stakeholders how they can access their privacy information, correct privacy information held by us, and lodge complaints.
    3. 1.2.3. National Media and its related companies have a firm commitment to privacy in accordance with the Privacy Act 1988 (Cth) as amended, including the Privacy Amendment (Enhancing Privacy Protection) Act 2012, the Privacy Amendment (Notifiable Data Breaches) Act 2017, and the Australian Privacy Principles (APPs).

2. COLLECTION OF INFORMATION

  1. 2.1.The kinds of personal information we collect includes:
    1. 2.1.1. Name
    2. 2.1.2. Address
    3. 2.1.3. Contact telephone number and email
    4. 2.1.4. Occupation
    5. 2.1.5. Digital engagement data.
  2. 2.2.We do not intend to collect sensitive information, such as your political opinions or ethnic origin.

3. HOW WE COLLECT INFORMATION

  1. 3.1.Like any business, knowing our clients and understanding the nature of our business is central to what we do. We collect information directly from you by the following means:
    1. 3.1.1. Online form or survey
    2. 3.1.2. Hard copy form or survey
    3. 3.1.3. On-ground oral survey
    4. 3.1.4. Phone oral survey
    5. 3.1.5. Event registration
    6. 3.1.6. Subscription to our digital media publications
  2. 3.2.While our general policy is to collect information from you directly and not from third parties, there are circumstances where it is unreasonable or impracticable to collect privacy information from you directly. For example, often collecting information from a broad range of potential clients and stakeholders is not feasible or possible without obtaining information from third parties, such as member associations. In these circumstances, we collect information about attendees and exhibitors indirectly from third parties, where that third party is lawfully permitted to disclose that information.
  3. 3.3.We are under a presumption that if you are an attendee of an exhibition or client of ours you expect to receive marketing communications from us or an exhibitor about an event.
  4. 3.4.This policy acts as notice to all attendees and exhibitors that we intend to collect personal information indirectly from third parties in order to improve our exhibition business for the benefit of all taking part. If you disagree or have a query with regard to us collecting your information from third parties, you may contact our Privacy Officer and request that we:
    1. 3.4.1. Cease disclosing information to exhibitors for the purpose of facilitating marketing
    2. 3.4.2. Disclose the source by which we received your information
    3. 3.4.3. If we receive either request we will, within a reasonable time, either cease disclosing your personal information to exhibitors or notify you of our third-party source, unless an exception applies.
  5. 3.5.If you use any of our websites, including our digital media publications, we may also collect information that is Personal Information, and some information such as that identified in our Terms and Conditions by our use of cookies. Some of that information may be Personal Information and to the extent that it is, this Privacy Policy applies to that information.
  6. 3.6.We may collect personal information from publicly accessible sources. This may include information from business directories, social media platforms and publicly available websites. The information collected through such means is limited to data that is already publicly available and is used for purposes such as business intelligence, market research and improving our services.

4. INFORMATION COLLECTED BY NATIONAL MEDIA BUSINESS DIVISIONS

  1. 4.1.National Media operates several business divisions and brands, including but not limited to:
    1. 4.1.1. Foodservice Australia
    2. 4.1.2. Food & Hospitality Week
    3. 4.1.3. Queensland Restaurant & Foodservice Show
    4. 4.1.4. Pizza, Pasta & Italian Food Show
    5. 4.1.5. Commercial Kitchen Show
    6. 4.1.6. Restaurant Technology Show
    7. 4.1.7. Restaurant Business Australia
    8. 4.1.8. Design Show Australia
    9. 4.1.9. ArchiBuild Expo
    10. 4.1.10. Kitchen & Bath Show
    11. 4.1.11. Workplace Health & Safety Show
    12. 4.1.12. AusFitness Industry Expo
    13. 4.1.13. AusFitness Expo
  2. 4.2.When you interact with any National Media division or brand:
    1. 4.2.1. All such data collection and processing is governed by this privacy policy.
    2. 4.2.2. You may receive communications from any of National Media's divisions or brands if you have provided consent.
    3. 4.2.3. Your information may be used across National Media's various divisions and brands to provide you with relevant content, newsletters and communications.
    4. 4.2.4. All such data collection and processing is governed by this privacy policy.

5. PURPOSES FOR WHICH WE COLLECT AND DEAL WITH YOUR INFORMATION

  1. 5.1.We run a national exhibition business and digital media business in Australia. Our main purposes are to facilitate exposure of organisations and businesses to new customers and clients through both exhibitions and digital media platforms such as Restaurant Business Australia. Marketing is central to our business model.
  2. 5.2.We collect personal information to promote our exhibitions and digital media platforms, and to facilitate communication between exhibitors, attendees, advertisers, readers, and subscribers.
  3. 5.3.As a general principle, we only use privacy information for the primary purpose for which we collect the information or a secondary purpose related to the primary purpose for which you would reasonably expect us to use the collected information.
  4. 5.4.The list of potential primary purposes for which we collect and deal with your privacy information is as follows:
    1. 5.4.1. To enable us to communicate with attendees in organising and arranging exhibitions
    2. 5.4.2. To identify and invite potential exhibitors to an event
    3. 5.4.3. To identify and invite potential attendees to exhibitions
    4. 5.4.4. To allow us to send past or prospective attendees promotional offers and information about special events
    5. 5.4.5. To share information about past and prospective attendees with exhibitors for marketing purposes
    6. 5.4.6. To provide relevant industry content, news and updates through our digital media platforms, including Restaurant Business Australia
    7. 5.4.7. To deliver newsletters and digital communications to subscribers of our digital media platforms
    8. 5.4.8. To provide advertisers with relevant audience data and insights from our digital media operations
    9. 5.4.9. To allow us to conduct our business operations: Administrative, marketing, planning, product development and research activities
    10. 5.4.10. To use remarketing or similar audience features, and any other purpose identified in our Terms and Conditions.

6. DIRECT MARKETING

  1. 6.1.In all direct marketing communication you receive from us we will include a simple opt-out procedure by which you may easily request to not receive direct marketing communications. We will process all unsubscribe requests within 5 business days of receipt and honour opt-outs immediately upon processing.
  2. 6.2.In the circumstance we collect information from third parties and intend to use that information for direct marketing, any direct marketing communication is subject to your prior consent. To this end, we collect information from third parties on the understanding that individuals have given their consent to the third party for us to use the information for direct marketing. You are also entitled to opt-out of any direct marketing you receive from us.
  3. 6.3.You are entitled to request a third party to not share your information with third parties.

7. DISCLOSING INFORMATION

  1. 7.1.We will only disclose personal information in accordance with the Privacy Act. This means that it will be disclosed if:
    1. 7.1.1. We told you when collecting it that it would be disclosed for that purpose or for a related purpose that you would reasonably expect
    2. 7.1.2. We have your consent
    3. 7.1.3. It is part of business assets which we are selling
    4. 7.1.4. We are required by law to disclose it
    5. 7.1.5. It is otherwise permitted under the Privacy Act.

8. CROSS-BORDER TRANSFER OR DISCLOSURE OF INFORMATION

  1. 8.1.In the event we transfer information to an entity overseas, such as routing or storing information on cloud servers located overseas or transferring information to an office of our company overseas, we will ensure that adequate security mechanisms are in place to protect your information. For example, we will enter into a contract with the cloud server that ensures the information is for the limited purpose of storing and managing personal information.
  2. 8.2.We do not currently make overseas disclosures. However, it is possible that our business will develop marketing or research activities overseas that require us to make cross border disclosures.
  3. 8.3.In the event we make cross border disclosures, we will, unless an exception applies, put in place mechanisms to ensure your personal information is under a standard of protection that complies with the Australian Privacy Principles. Mechanisms may include:
    1. 8.3.1. Verifying that the recipient to which the information is transferred overseas is subject to binding and enforceable laws that protect the information to a substantially similar standard as that imposed by the Australian Privacy Principles; or
    2. 8.3.2. We enter into a contract or memorandum of understanding that requires overseas recipients and any subcontractors to comply with the APPs in relation to the disclosed information.

9. THE CONSEQUENCES OF NOT PROVIDING US WITH PERSONAL INFORMATION

  1. 9.1.If you choose to not provide us with personal information, our ability to perform some essential business functions might be compromised. This includes facilitating communication between attendees and exhibitors at our exhibitions, delivering relevant digital content to subscribers of our digital media platforms like Restaurant Business Australia, providing industry insights to advertisers, and personalising your experience across our services. Without certain personal information, we may be unable to deliver newsletters, event invitations, or targeted industry content that matches your professional interests and needs.

10. USE OF COOKIES

  1. 10.1.National Media uses a browser feature known as a cookie, which assigns a unique identification to your computer. Cookies also allow National Media to make our sites more responsive to your needs, by delivering a better and more personalised experience to you. The cookies are typically stored on your computer’s hard drive and are used by National Media to help track your clicks as you go through the pages within one of our websites. This allows registered users to avoid re-entering information upon every new visit to our sites.
  2. 10.2.National Media may also use the information obtained through cookies to refine our marketing strategies, such refinement may include sharing such non-personally identifiable information with third party marketing and analytic providers (i.e. Google, etc.).

11. MAINTAINING THE INTEGRITY, CURRENCY AND SAFETY OF YOUR PRIVACY INFORMATION

  1. 11.1.Maintaining the currency of your information
    1. 11.1.1. We rely on accurate and reliable information to deliver successful exhibitions. If we are satisfied, that any of the information we have about you is inaccurate, out-of-date, irrelevant, incomplete or misleading, or you request we correct any information, we will take steps as are reasonable in the circumstance to ensure the information held by us is accurate, up-to-date, complete, relevant and not misleading.
  2. 11.2.Maintaining the currency of your information
    1. 11.2.1. All privacy information is securely stored using appropriate electronic security technology, settings and applications, and by ensuring staff dealing with privacy information is trained in our privacy policies and procedures, such as our Privacy Policy and Data Stewardship System.
    2. 11.2.2. These policies and procedures are designed to protect privacy information from unauthorised access, modification or disclosure and from misuse, interference and loss.
  3. 11.3.Maintaining the currency of your information
    1. 11.3.1. All privacy information is securely stored using appropriate electronic security technology, settings and applications, and by ensuring staff dealing with privacy information is trained in our privacy policies and procedures, such as our Privacy Policy and Data Stewardship System.
  4. 11.4.Maintaining the currency of your information
    1. 11.4.1. If at any time we discover that information held by us is inaccurate, not up-to-date, incomplete, irrelevant or misleading, or you request us to correct information held by us, we will take reasonable steps to correct that information.
    2. 11.4.2. If we disclose your privacy information that is later corrected, we will, or else you may ask us to, notify the entity that received the incorrect information about that correction. Should we refuse to correct the information, we will explain the reasons for the refusal.
    3. 11.4.3. We will also show you the complaint procedure if you wish to lodge a formal complaint about our refusal.
  5. 11.5.Lodging a complaint
    1. 11.5.1. Should you wish to complain about a potential breach of this Privacy Policy or the Australian Privacy Principles please contact our Privacy Officer. The Privacy Officer will make good faith efforts to rectify the issue and respond within a reasonable period after the complaint is made.
